can I add the notice on the index.php of zenphoto only one page and that notice will not show on album page(index.php?album=... and another)?

Each of the pages (index.php, album.php, image.php, etc.) is independent from the rest. So if you put a notice in your index.php script it will show only on the index page of your theme.
